Introduction
Welcome to Highline Homes. These Terms & Conditions (“Terms”) govern your use of our website, highlinehomes.com (the “Site”), and your engagement of our services, including custom home building, remodeling, design-build, and related construction services (the “Services”). By accessing our Site or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Scope of Services
- Highline Homes provides custom home building, luxury renovations, additions, and design-build solutions.
- Proposals, designs, and estimates are for informational purposes until incorporated into a signed agreement.
- Timelines and costs are subject to permitting, material availability, and client selections.
- We may engage subcontractors, suppliers, and consultants as part of project execution.
Client Responsibilities
By engaging our Services, you agree to:
- Provide accurate project details, site access, and required approvals.
- Secure financing necessary for the project prior to commencement.
- Make payments as outlined in your contract.
- Comply with all applicable homeowner association requirements, municipal codes, and zoning laws.
Payment Terms
Deposit: A non-refundable deposit is required before project initiation.
Progress Payments: Payments are due according to the schedule defined in your Service Agreement.
Late Payments: Outstanding balances may accrue interest at the maximum rate allowed under Texas law.
Non-Payment: Failure to pay may result in suspension of work, termination of the contract, and/or lien filings against the property.
Intellectual Property
- All architectural drawings, renderings, designs, photographs, and related materials created by Highline Homes remain the exclusive property of ATX Luxury Builders LLC, unless expressly transferred in writing.
- Clients are granted a limited, non-transferable license to use such materials for their personal residential project only.
Warranties
- Highline Homes provides warranties consistent with applicable Texas law and industry standards.
- Warranty coverage does not include:
- Normal wear and tear;
- Improper use or maintenance by the homeowner;
- Alterations made by third parties;
- Damage caused by natural disasters, accidents, or external factors beyond our control.
Except as specifically stated in writing, all Services are provided “as is” without any additional warranties.
Limitation of Liability
To the fullest extent permitted by law:
- Highline Homes and ATX Luxury Builders LLC shall not be liable for indirect, incidental, special, or consequential damages.
- Our total liability for any claim shall not exceed the total amount paid by the Client for the Services giving rise to the claim.
Website Use
- All content on the Site is for informational purposes only and does not constitute a binding offer.
- While we strive for accuracy, we make no guarantees regarding the completeness or reliability of information provided.
- Users must not misuse the Site, including attempts to disrupt or damage systems, engage in fraudulent activity, or violate applicable laws.
Privacy
We respect your privacy. The collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms. By using our Site or Services, you consent to such use.
Governing Law & Dispute Resolution
These Terms and any Service Agreements are governed by the laws of the State of Texas.
Disputes shall first be submitted to good-faith mediation. If unresolved, they will be resolved through binding arbitration in Travis County, Texas.
Each party shall bear its own costs unless otherwise determined by the arbitrator.
Modifications
We may amend these Terms at any time. Updates will be posted on this Site with a new Effective Date. Your continued use of our Site or Services after such updates constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with any signed Service Agreement, constitute the entire understanding between you and Highline Homes regarding your use of our Services and supersede all prior discussions or representations.
